These Terms of Service ("Terms") govern your access to and use of Store Backup for Shopify (the "Service"), operated by Store Backup & Restore. In these Terms, "Store Backup", "we" and "us" mean the operator of the Service. By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The service
Store Backup saves versioned copies of your Shopify store data and lets you restore items to a previous version. Backups run automatically every day, and some changes are also saved shortly after they happen. The data covered, and what can and cannot be restored, is listed on the What is covered section of this website and in the app.
A restore writes the saved version over the current data of your store. Before a restore overwrites an item that still exists, we save a copy of its current state, so the restore can be undone. A deleted item that is restored comes back with a new ID. Orders are never written back to your store.
Plans and billing
- The Service has a free plan and paid plans. Every plan, with its monthly and yearly price, is listed on the pricing page.
- Your first paid plan starts with a 7-day free trial.
- Paid plans are billed by Shopify, on your regular Shopify bill, until you change or cancel them. By choosing a paid plan, you authorize these recurring charges.
- You can change your plan, switch between monthly and yearly billing, or go back to the free plan at any time from the app. Billing changes, and any credit for a change in the middle of a billing period, are handled by Shopify's billing system.
- Except where Shopify's billing system applies a credit, or where the law requires otherwise, fees already paid are not refunded.
- Going over your plan's monthly order limit never pauses your backups, and we never change your plan for you.
Your responsibilities
- You are responsible for the security of your Shopify account, and for the actions your store's users take in the Service.
- You use the Service only for lawful purposes, and you do not misuse, disrupt or try to gain unauthorized access to it.
- A restore overwrites current data. You are responsible for checking what you restore before you start it.
- You are responsible for having the right to send us the personal data of your customers that your store holds, and for answering your customers' requests about it.
Availability and accuracy of backups
We work to back up your data reliably, and the app shows you when a backup fails or is only partial, with the reason. The Service still depends on the availability and limits of Shopify and of third-party providers. We do not warrant that backups will be complete, uninterrupted or error-free, and the Service does not replace your own records. You are responsible for checking that data that matters to you has been backed up.
Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, Store Backup and its operator are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.
Termination
You can stop using the Service at any time by uninstalling the app. We may suspend or end access if you breach these Terms, or to comply with the law. When the Service ends, your stored backups are deleted as described in our Privacy Policy.
Changes to the service and these terms
We may update the Service and these Terms. For important changes to these Terms, we change the "Last updated" date above and tell you by email or in the app. If you keep using the Service after the changes take effect, you accept the updated Terms.
Governing law
These Terms are governed by the laws of USA, without regard to its conflict-of-laws rules. Any dispute will be subject to the courts located in CA, San Francisco.
